Reckless Driving Is a Criminal Offense in North Carolina

There are two ways you can be charged with reckless driving in North Carolina. A motorist is guilty of this offense if he or she drives a motor vehicle on a highway or public area:

  • “Carelessly and heedlessly” in willful disregard of the safety of others, or
  • At speed or in a manner that could or does “endanger any person or property.”

Several different driving actions can lead to this charge, such as driving excessively over the speed limit, running a stop sign or red light while speeding, crossing the yellow line, making illegal and dangerous passes, speeding to elude police officers or driving off the road.

It’s important to know that reckless driving is a Class 2 misdemeanor. That means you can be fined $1,000 and possibly serve as many as 60 days in jail depending on your criminal record.

On top of that, you could have four points added to your driving record. This is serious, because your license could be suspended or revoked if you compile 12 points within a three-year period.

Also, the charge could produce four insurance points. This means that you could have a 90 percent surcharge tacked onto your premium payments.
